Hawaii Secretary of State Business Search (2026): How to Check Name Availability

Hawaii doesn’t have a Secretary of State business registry. Businesses register with the Department of Commerce and Consumer Affairs (DCCA), Business Registration Division (BREG), and its free Business Name Search on Hawaii Business Express is the official place to check whether a name is already registered.

One Hawaii quirk to know up front: BREG only checks whether a name is substantially identical to an existing registration. Making sure your name won’t confuse the public is your responsibility. Once you find an open name, you can reserve it for 120 days for $10.

Updated October 2026.

Because BREG’s own review is narrow, a careful search matters more in Hawaii than in many states.

  1. Open the Business Name Search. Use the search page on Hawaii Business Express. It’s also linked from DCCA’s Business Check page.
  2. Enter the business name. Search the distinctive words without LLC or Inc. For “Kona Reef Tours LLC,” try “Kona Reef” first, then variations.
  3. Open matching records. Each record shows the registered information, such as when the business was established, the people involved and any previous names. Copies of documents can be bought from the same record ($3 regular, plus $10 for certification).
  4. Check registered trade names. BREG also registers trade names, trademarks and service marks, so look for any registered trade name close to yours; it signals likely confusion.
  5. Judge confusion yourself. BREG won’t stop a name that is merely similar. If an existing business uses a name close enough that customers could mix you up, choose something else.

A practical Hawaii tip: popular local words such as aloha, ohana, kai or island and town names appear in a large number of business names. Search the common word on its own to see how crowded it is, and build your name around a more distinctive element so customers can tell you apart.

Prefer paper? BREG’s records can also be viewed in person in Room 201 at 335 Merchant Street, Honolulu.

According to the BREG FAQs, the Department only checks for an existing registration that is substantially identical to yours. Applicants are responsible for ensuring the name is not already in use, or so close to one in use, that the public would be confused.

  • LLC designator: a Hawaii LLC name needs “Limited Liability Company” or an abbreviation such as “LLC” or “L.L.C.”
  • Corporate designator: a corporation needs “Corporation,” “Incorporated” or “Limited,” or an abbreviation of one.
  • Use beats registration for trade names: ownership of a trade name in Hawaii comes from open, continuous use in the marketplace, not from registering it. A prior user can have rights even if they never filed anything.
  • Regulated terms: words implying banking, insurance or a licensed profession may need approval from the relevant DCCA licensing or financial regulator.

Short on ideas? Namechk’s business name generator suggests options you can run through the Hawaii search.

An entity name reservation holds a name while you prepare your formation documents. The BREG FAQs and fee schedule set the terms:

  • Fee: $10 for an LLC, corporation, partnership or limited partnership name; expedited review adds $25.
  • Length: an approved reservation lasts 120 days.
  • How to file: online through Hawaii Business Express.
  • Transfer: $10.
  • Cancellation: there’s no BREG form; a signed letter from the applicant is accepted.

Reserve when you need breathing room, for example while you finalize an operating agreement or secure a lease. If you can file your Articles of Organization within a few days, the reservation adds little, because filing the Articles registers the name anyway.

A Hawaii registration doesn’t protect your name nationally. Search the USPTO trademark database for marks that could conflict with yours, particularly if you’ll sell online or to visitors from the mainland.

Next, check the web. Namechk shows whether matching domain names and social usernames are available in one search, which helps you pick a name you can use everywhere.

Hawaii registers trade names at the state level with BREG under HRS Chapter 482. Details from the trade names page and FAQs:

  • Fee: $50 (Form T-1), plus $20 for expedited review. Fees aren’t refundable.
  • Filing: online through Hawaii Business Express, or on paper by mail, in person, email or fax.
  • Optional: BREG says registration isn’t required. It gives notice of your claim and can reveal others claiming the same name.
  • Term: five years. Re-register during the six months before expiration; a renewal is also good for five years.
  • No reminders: BREG doesn’t send expiration notices, and anyone may register the name after it lapses, so track the date yourself.

Even though Hawaii doesn’t require a trade name filing, banks and payment processors may ask for proof of registration before accepting payments under a DBA.

Once the name is settled, our Hawaii LLC guide and DCCA’s steps to starting a business cover the process:

  1. File Articles of Organization ($50) or Articles of Incorporation online with BREG.
  2. Designate a registered agent with a Hawaii street address. Mainstay Filing includes one with formation, and our Hawaii registered agent guide explains the requirements.
  3. Get an EIN and a General Excise Tax license from the Hawaii Department of Taxation. Our Hawaii start-a-business guide covers other permits.
  4. File the annual report ($15 for an LLC) each year to stay in good standing.

Does Hawaii have a Secretary of State business search?

No. Hawaii has no Secretary of State business registry. Does Hawaii check if my business name is confusing?

Only partly. The Business Registration Division checks whether your name is substantially identical to an existing registration. Search registered names, trade names and trademarks before filing.

Is a DBA required in Hawaii?

No. Hawaii trade name registration is optional, according to the Business Registration Division. Ownership comes from open, continuous use, but registering ($50) gives notice of your claim. A registration lasts five years and must be renewed in the six months before it expires; the state doesn’t send reminders.

The Business Registration Division charges $50 to file Articles of Organization for a Hawaii LLC, plus $25 if you want expedited review and a $1 State Archives fee on permanent records.
