A registered agent in Montana is the person or company named on your state filings to accept lawsuits, subpoenas and official notices for your LLC or corporation. Montana law requires every LLC and corporation to keep one, with a physical street address in Montana. The Montana Secretary of State charges no fee to change your registered agent as of October 2026. Our recommendation is Mainstay Filing at $149 a year, with Montana Registered Agent.co as a lower-cost alternative.

What does a registered agent do in Montana?
A Montana registered agent is your company’s official mailbox for legal matters. When someone sues your LLC, a court clerk issues a subpoena, or a state agency needs to send a formal notice, the paperwork goes to the registered agent at the address on file with the Secretary of State.
Montana’s Model Registered Agents Act keeps the agent’s legal duties narrow. Under MCA 35-7-114, the agent must forward any process or notice to the company at the last address the company provided, and must keep its own information on file current. That is the whole job, but it matters: a missed summons can lead to a default judgment against the business.
In practice, a good Montana registered agent also:
- Accepts deliveries in person during normal business hours
- Scans or forwards documents to the owners without delay
- Keeps your home address off the public business record if you use the agent’s address
Who can be a registered agent in Montana?
Montana recognizes two kinds of registered agent under MCA 35-7-105:
- Commercial registered agent: an individual or business that files a listing statement with the Montana Secretary of State and serves many companies. When you name a listed commercial agent, you only give its name; the state already has its Montana address.
- Noncommercial registered agent: anyone else who agrees to serve, such as a member, manager, officer, friend or attorney. You list the agent’s name and Montana street address on your filing.
Either way, the Secretary of State’s guidance is direct: the agent needs a physical Montana address, and if you do not have one, you must hire a commercial registered agent. An out-of-state owner cannot simply list a home address in another state.
Can you be your own registered agent in Montana?
Yes. A Montana resident who owns or manages the business can act as its noncommercial registered agent, provided he or she has a physical Montana address where process can be delivered.
Reasons to serve as your own agent – No annual service fee – You see legal papers the moment they arrive – Simple for a single-location business run from a Montana storefront or office
Reasons to hire a service instead – Your street address becomes part of the public record on the Secretary of State’s business search – Someone must be available at that address during business hours, which is hard if you travel, work job sites or farm – A process server can arrive in front of customers or family – If you move out of Montana, you have to file a change anyway
For owners outside Montana, a commercial agent is not optional. It is the only practical way to meet the in-state address rule.
How much does it cost to change a registered agent in Montana?
Nothing, at the state level. The Montana Secretary of State lists the Statement of Change of registered office, registered agent or both as “no fee” on its current fee schedule (as of October 2026). Optional 24-hour priority handling costs $20 and one-hour expedite costs $100 on the same schedule.
You can also update the agent on your annual report. Montana’s annual report is due April 15; the SOS help center says the fee is waived for reports filed between January 1 and April 15, and the fee is $35 after April 15.
The only real cost of switching is the new agent’s own service fee. For a full picture of formation and upkeep costs, see Mainstay’s Montana LLC cost breakdown.
How do you change your registered agent in Montana?
Montana handles the change under MCA 35-7-108. The steps:
- Line up the new agent first. If you are hiring a commercial agent, sign up and confirm the exact name it is listed under with the Secretary of State.
- Log in to the Montana SOS business portal and find your entity.
- Choose the filing action for a registered agent or registered office change by entity.
- Enter the new agent: a commercial agent by its listed name, or a noncommercial agent by name and Montana street address.
- Submit. There is no state fee unless you choose priority or expedited handling.
- Search your company on the Montana business search afterward to confirm the record shows the new agent.
If the annual report is coming up, you can make the same update there instead of filing a separate statement.

FAQs
Is a registered agent required in Montana?
Yes. Montana requires every LLC, corporation and foreign entity registered with the Secretary of State to name a registered agent with a physical Montana address. The agent is listed on the formation filing and must stay current. If the agent resigns or moves, the business must file a Statement of Change, which carries no state fee as of October 2026.
How much does it cost to change a registered agent in Montana?
The Montana Secretary of State charges no fee for a Statement of Change of registered agent or registered office, according to its fee schedule as of October 2026. Optional 24-hour priority handling is $20 and one-hour expedite is $100. You can also change the agent when filing the annual report, which is due April 15.
Can I be my own registered agent in Montana?
Yes, if you have a physical street address in Montana and can be there during business hours to accept legal papers. Your address will appear in the public business record. Owners who live outside Montana cannot use their own address and need a commercial registered agent with a Montana office instead.
What is a commercial registered agent in Montana?
A commercial registered agent is an individual or company that has filed a listing statement with the Montana Secretary of State to serve many businesses. Once listed, its Montana address is kept on file centrally, so companies naming it only enter the agent’s name. Anyone not listed this way serves as a noncommercial registered agent.
Can a Montana registered agent use a P.O. box?
No. Process servers must be able to hand documents to someone in person, so Montana requires a physical street address in the state for the registered agent. A P.O. box or mail drop does not qualify, although a separate mailing address can be listed for the business itself.
How much does a registered agent service cost in Montana?
Private registered agent fees are set by each provider, not the state. Among our recommendations, Mainstay Filing charges $149 a year and renews at $149, and Montana Registered Agent.co charges a flat $99 a year. The state itself charges nothing to appoint or change an agent.
What happens if my Montana LLC has no registered agent?
An LLC without a valid registered agent risks missing lawsuits and state notices, which can lead to default judgments. It also falls out of compliance with Montana’s registered agent statute and puts its good standing with the Secretary of State at risk. Fixing it is simple: appoint a new agent through the online portal, at no state fee.
