2. Search the key words
Type the distinctive part of your name and skip the ending. “Mountain Laurel” will catch “Mountain Laurel LLC,” “Mountain Laurel, Inc.” and “Mountain Laurel Farms” in one pass.
3. Compare names the way the state does
The office’s Business Name Guidance lists the tests examiners use. Ask yourself whether your name would look noticeably different if read aloud, seen on a billboard or listed alphabetically next to the existing one. Sound-alikes (“Squash Farm” vs. “Squash Pharm”) and plurals (“Apple Sauce” vs. “Apple Sauces”) fail.
4. Watch for industry synonyms
West Virginia treats some industry words as interchangeable. The guidance says “K&C Real Estate” and “K&C Realty” are not distinguishable, nor are “ABC Construction” and “ABC Contracting” or “Farthing Holdings” and “Farthing Holdco.” Swapping a synonym rarely works.

The instructions on Form NR-1 and the state’s naming guidance set out the requirements:
- LLCs must include “Limited Liability Company,” “Limited Company,” L.L.C., LLC, L.C., LC or Ltd. Co. Professional LLCs need board approval and must use a PLLC-style ending.
- Corporations must include Incorporated, Corporation, Company, Limited, Inc., Corp., Co. or Ltd.
- Restricted terms: “banking” and “insurance” only if the business does that work; “engineer” or “engineering” only for professional engineering firms with a registered WV engineer; “911” is prohibited.
- No false government ties: words like Agency, Commission, Department, Bureau, Division, Municipal or Board in a way that implies government affiliation are generally refused.
- Not distinguishing: articles and conjunctions (The, A, And), punctuation, capitalization, the entity type alone (“Storm Chasers Ltd.” vs. “Storm Chasers Co.”) and contractions or abbreviations (“Mister Coffee” vs. “Mr. Coffee”).
- Usually distinguishing: a different key word, a word-order change with a preposition (“Towing by Smiley”), or a foreign-language version of an English name.
How to reserve a business name in West Virginia
Reserving is optional but cheap. The Secretary of State’s name reservation page and Form NR-1 explain the process:

- Complete Form NR-1, choosing the entity type and whether you plan to organize a new West Virginia company, change an existing name or qualify a foreign company.
